In compliance with the requirements of Republic Act No. 10173 or the Data Privacy Act of 2012 (DPA), and its Implementing Rules and Regulations (IRR), Kintetsu World Express (Philippines) Inc. and its subsidiary companies, (“Company”), respect and value your data privacy rights, and ensure that all personal data collected from you in the course of your transactions with the Company, which may include personal information and/or sensitive personal information, are processed in adherence to the general principles of transparency, legitimate purpose, and proportionality. 

Essentially, we are committed to protecting your personal and proprietary data on the channels or platforms you interact with us – through our subsite, in our branches and offices, and other online and offline channels or platforms, and assure you that processing your personal and proprietary data will strictly follow the provisions of the DPA.

This Privacy Notice is for the KWE Philippines's subsite. These functionalities enable KWE Philippines to collect and process your personal information.

Our website/subsite uses cookies to check if your computer has the Flash Plug-in installed for enhancement of your accessibility to certain site content. We do not use cookies to collect any Personal data. A cookie is one of the mechanisms to identify a website user's computer. HOW WE USE THE INFORMATION WE COLLECT

We use personal and proprietary information collected through our Services for purposes described in this Privacy Notice or otherwise disclosed to you on or in connection with our Services. In these instances, your personal and proprietary data is utilized for the following purposes: 

  • For documentation and processing of inquiries, requests, and comments to enable us to properly provide customer service by addressing and forwarding them to the appropriate internal resource/units for proper action and response;
  • Provision and delivery of Services you requested, processing of transactions, and sending of pertinent information in relation thereto;
  • Provision of appropriate updates and advisories in an appropriate format in an orderly and timely manner;
  • Operate and improve our Services by integrating feedback mechanism to assess service effectiveness;
  • To be able to provide the appropriate action that a data subject may require concerning their data privacy rights.

Where you have provided us with your Personal Data whether through the “Contact us” or other channel or platform mechanism in order to inquire about our services, view certain parts of its content or avail yourself of our online information services, you agree and consent to our collection, use, disclosure, storage and other processing of your personal data for the purposes, in the manner, and under the terms set forth in this Privacy Notice. You understand and accept that this will include access to personal data and records submitted, which may be regarded as personal and/or sensitive personal data as provided under the Data Privacy Act of 2012.

Moreover, please allow for possible limited availability of our subsite content and online information services in case you opted not to provide or register any of your Personal data. Furthermore, while your consent may be solicited to process your personal and proprietary data through our services, we may also process personal and proprietary data without your consent, such as when processing is officially required or allowed under Section 12 or Section 13 of the DPA.

DISCLOSURE OF PERSONAL DATA

Personal data processed is not shared with any other party unless such disclosure is allowed under Section 12 or 13 of the DPA.

DATA PROTECTION AND SECURITY MEASURES

We safeguard the confidentiality, integrity, and availability of your personal information by maintaining a combination of organizational, physical, and technical security measures based on generally accepted data privacy and information security standards. Among the measures we implement are the following:

  • Policies on access control in both digital and physical infrastructures to prevent unauthorized access to personal information.
  • Acceptable use policies
  • End-to-end encryption and data classification whenever suitable.
  • Security measures against natural disasters, power disturbances, external access, and similar threats.
  • Technical measures to protect our computers and databases against accidental, unlawful, or unauthorized usage, interference, or access.

 

STORAGE AND RETENTION

We store files containing personal or proprietary information in our computers and servers, which are kept in a secure environment. We shall ensure that proper measures are adopted to protect your information.

Personal and proprietary data shall be retained for as long as it is necessary for the stated purposes unless a longer retention period is required or allowed by law. When the information that we collect is no longer required or we no longer have a legal or legitimate purpose for retainng your personal data, records shall be disposed of securely.

DISPOSAL

Physical records shall be disposed of through shredding, while digital files shall be purged. In all instances, our manner of disposal shall ensure that the personal information shall no longer be retrieved, processed, or accessed by unauthorized persons.

 

RIGHTS OF A DATA SUBJECT

Under the DPA, you have the right to be informed regarding processing the personal information we hold about you. Further, you may be entitled to request:

 

  1. Right to Access. It is your right to obtain confirmation on whether or not data relating to you are being processed;
  2. Right to Rectification. As Data Subject, it is your right to dispute the inaccuracy or error in the processed personal information and inform the Personal Information Controller to correct in accordance with the existing policy or process;
  3. Right to Erasure. You have the right to order the erasure or blocking of your personal data whenever warranted;

FEEDBACK ON OUR PRIVACY NOTICE

We reserve the right to amend, alter, modify and/or change this Privacy Notice as the exigencies of the time may warrant, and such amendments, alterations, modifications and/or changes shall be an integral part of this Privacy Notice.
