Customer Advisory: Potential Duty Refunds on Japanese Origin Imports

As an update to the guidance issued through above referenced CSMS 66242844 on Sept.15, 2025, as well as CSMS 66146676 "Interim Guidance: Retroactive Implementation of the US-Japan Agreement" issued on Sept.05, 2025, filers can update their previously filed entries to apply the newly issued HTSUS numbers since they are now deployed as of Sept.16, 2025!
As explained in the Executive Order 14345, under the Agreement, the United States will apply a baseline 15 percent tariff on nearly all Japanese imports entering the U.S., alongside separate sector-specific treatment for automobiles, automobile parts and aerospace products, which only goes into effect on Sept.16, 2025.
KWE’s Corporate Compliance group is already compiling information to identify and conduct outreaches with eligible clients, to identify every qualifying shipment where the additional duty on Japanese imports was paid from Aug.7, 2025 to date, based on the effective date of the agreement. Eligible shipments that were cleared on and after that date will either be eligible for a refund of duties paid, OR, subjected to additional duties if the general rate (Column 1) rate of duty was less than 15%. Additional efforts are already underway to identify and conduct outreaches with those customers who may have eligible shipments (that have been previously paid) to then provide you Post Summary Correction services for processing of the refund requests (or supplemental duty payments) as may be applicable.
