Following the Supreme Court ruling on February 20, 2026, President Trump issued an Executive Order “Ending Certain Tariff Actions.” U.S. Customs and Border Protection (CBP) subsequently issued CSMS # 67823350 - Supreme Court of the United States (SCOTUS) Judgment - International Emergency Economic Powers Act (IEEPA) Tariffs confirming that additional guidance would be provided. This was followed by CSMS # 67834313 - Ending Collection of International Emergency Economic Powers Act Duties, on February 22. That same day, the White House issued a Proclamation and Fact Sheet authorizing new Section 122 tariffs (Trade Act of 1974) of up to 10% on all goods, for a period of 150 days, excluding certain items listed in Annex I and Annex II.
On February 23, CBP issued:
- CSMS # 67844987 - Imposing Temporary Section 122 Duties
- CSMS # 67845486 - Continuing the Suspension of Duty-Free De Minimis Treatment for All Countries
The Proclamation also provides an in-transit exemption for goods that:
- Were loaded onto a vessel at the port of loading and in transit on the final mode of transit prior to entry into the United States, before 12:01 a.m. EST on February 24, 2026; and
- Are entered for consumption, or withdrawn from warehouse for consumption, before 12:01 m. EST, February 28, 2026.
