U.S. Customs User Fee Adjustments to be Enforced October 1

On July 31, the U.S. Customs and Border Protection (CBP) published a general notice—later posted on the Federal Register—of several adjustments to select customs user fees and their respective limitations for Fiscal Year 2023, effective October 1, 2022.

These adjustments are attributed to Section 32201 of the 2015 Fixing America’s Surface Transportation (FAST) Act, which amends Section 13031 of the 1985 Consolidated Omnibus Budget Reconciliation Act (COBRA) and empowers CBP to determine any adjustments and limitations with respect to U.S. annual rate of inflation—a year-over-year increase of 9.1% (before seasonal adjustment) by the June 2022 Consumer Price Index.

Although the minimum and maximum Merchandise Processing Fee (MPF) limits for formal entries (class code 499) will be adjusted for Fiscal Year 2023 (from $27.75-$538.40 to $29.66-$575.35), the ad valorem rate (0.3464%) will not change.
