U.S. Compliance Advisory: Consumer Product Safety Commission Special Advisory

In January, 2026, the U.S. Consumer Product Safety Commission (CPSC) posted a guidance together with the HTS list for the electronic filing of Certificates of Compliance. CPSC administers and enforces several federal statutes. This guidance and list are being provided again as a reminder to assist the trade community with complying with CPSC’s eFiling requirements that go into effect from JULY 8, 2026.

Products require certification when they are a consumer product, or part of a consumer product that is subject to a consumer product safety rule under the Consumer Product Safety Act (CPSA), or similar rule, ban, standard, or regulation under any other law enforced by the Commission, that is imported for consumption, warehousing, or distributed in commerce, and that is packaged, sold, or held for sale to, or for use by consumers!

Based on the CPSC Guidance and HTS List for the Electronic Filing (eFiling) of Certificates of Compliance, the importer is responsible for eFiling a certificate whenever required by CPSC rules. This responsibility is explicitly stated in the guidance to assist the trade community, including importers and brokers, in complying with CPSC’s eFiling requirements. Brokers may assist with the process, but the ultimate responsibility for compliance and eFiling rests with the importer.
