CSMS # 69994928 - Import Ban of Certain Polysilicon Products Under Proclamation 11052

U.S. Customs and Border Protection (CBP) is implementing a temporary import restriction on certain polysilicon products for importers that exceed historical import volumes or specified weekly quantity limits under a new Department of Commerce Temporary Final Rule (TFR).

The U.S. Department of Commerce will publish a Temporary Final Rule (TFR) on September 24, 2026 that establishes procedures to restrict stockpiling of polysilicon and polysilicon derivative products.

The rule is issued under Presidential Proclamation 11052, "Adjusting Imports of Polysilicon and Its Derivatives Into the United States."

If Commerce determines that an Importer of Record (IOR):

• is importing polysilicon products in volumes substantially above its historical average, or
• is a new IOR exceeding applicable weekly quantity limits,

that IOR will be prohibited from making further entries of certain polysilicon products until December 4, 2026.
