The Stay Order issued by the Court of Appeals for the Federal Circuit (CAFC) on the International Emergency Economic Powers Act (IEEPA) case leaves both importers and the government in limbo until August, as the oral argument date has been scheduled for July 31st. All active judges in the appellate court will be required to hear the case, rather than just the three judges who were originally on the panel. This is typically done for complex or important cases or when the court believes that a decision made by a three-judge panel could be incorrect or conflict with prior rulings. Therefore, the earliest possible decision would be in August, assuming no internal disagreements among the judges.
