The justices’ questioning centered around four issues such as taxation power; ‘regulating’ of importation included the power to impose taxes; limiting congressional authority of the executive function; and implications resulting from invalidating the tariffs. While one of the Justices described the return of the tariffs as a potential “mess”, one of the attorneys suggested ‘prospective’ as opposed to ‘retroactive’ tax relief…
