ARE THE IEEPA Tariff Refunds Under Way???
U.S. Customs and Border Patrol (CBP) advised the Court of International Trade (CIT) that it is not yet prepared to process the court-ordered refunds of tariffs imposed under the International Emergency Economic Powers Act (IEEPA), but is working to have the Automated Commercial Environment (ACE) programmed to do so within the next 45 days. ACE has also been updated so that goods previously entered into a Foreign Trade Zone (FTZ) will not be required to pay IEEPA tariffs when exiting the zone.
- CBP published a proposed rule on February 10, 2026, that would require the trade community to use the ACE Electronic Export Manifest (EEM) system for filing outbound vessel cargo transactions. The COAC Export Modernization Working Group (EMWG) worked with CBP and the U.S. Census Bureau to develop this concept. The proposed rule aims to enhance visibility of outbound vessel cargo by requiring submission of electronic export vessel manifests prior to cargo departure from the United States.
