CBP Releases New Section 232 Compliance Guidelines for Aluminum Articles

Following the announcement of a 200% tariff on Russian aluminum, the US Customs and Border Protection agency released new guidance to comply with reporting requirements on the recently issued Proclamation 10522

According to Proclamation 10522, the following items will be subject to an ad valorem duty: any imports of aluminum articles or aluminum derivative articles that are produced in Russia (effective April 10, 2023) or in any other country using primary aluminum smelted or cast in Russia (effective May 10, 2023). The applicable tariff numbers are 9903.85.67 - 9903.85.70."


Under the new requirements for articles of aluminum subject to the Section 232 aluminum and aluminum derivatives remedies, "Importer’s Additional Declaration Type Code 07 (Aluminum Smelt and Cast Country Detail)" must be submitted if the article is regular aluminum, regular aluminum on the Generally Accepted Exclusion (GAE) list, or derivative aluminum regardless of whether the Section 232 duty treatment, quota treatment, or exception treatment applies.
